CONFIRMATION DEED AND CANCELLATION DEED


It is very common that many a times the main documents of sale, mortgage, lease are drafted by inexperienced, unqualified people, as result of which defects creep into the documents.This ecessitates the requirements of supplementary documents to remedy the mistakes. Deeds of confirmation, rectification and cancellation are some of the important supplemental deeds. We have already dealt with rectification deed. This write up deals with confirmation deed and cancellation deed.

There are two types of confirmation deeds, one of the types is, where a person confirms and assents to the document of conveyance executed by another person. This becomes necessary, when a person is not made a party to the main document of conveyance either by oversight or by ignorance or by some other reasons. Another type is very important.

Here the party to a document has made some mistake in signing the main document or has failed to admit the execution before the sub-registrar within the prescribed time, and consequently the sub-registrar has refused to register the document as far as the said party is concerned or in some other respect. It is very common though the parties executes the documents, but fails to turn up at sub-registrars office to admit execution, and the registering authority, refuses to register the document. In order to remedy this defect, a deed of confirmation has to be executed from the concerned party, wherein he confirms the execution of principal deed and further adds that the principal deed is valid and binding on him. He also confirms that he has no right, interest, title to the property transferred which belongs to the purchaser/transferee.

As a precautionary measure a copy of principal deed should be annexed to the deed of confirmation and such copy should also be signed by the party executing the confirmation deed. However, whether such a documents cures the defects of the main documents is debatable, but, such documents would act as promissory estoppel against the party. This would avoid execution of fresh documents, payment of tamp duty and registration charges. The word confirmation in strict parlance mean approbation or assent to the estate already created, by which confirming party further strengthens and gives legal validity to such estate so far at it is his powers.

The confirmation may be given in variety of ways:
(1) by acquiescence 
(2) by limitation
(3) by deeds.

Confirmations of acquiescence and by limitations are the outcome of operation of law. The Indian registration recognizes confirmation deeds Sec. 17(1) provides any deed confirming any interest in immoveable property needs to be registered. The confirmation deed attracts stamp duty. If the main documents is registered or to be registered the corresponding confirmation deed also requires registration.

Deed of cancellation
Section 13 of specific relief Act 1963, deals with the cancellation deeds. There may be certain written documents which by their nature or by operation of law or by some other reasons are void, violable. Such documents if left as they are and outstanding may harm the interest, rignt, titles privileges of some party.Such person may institute a suit, praying for cancellation of such written document, and the court in its discretion if thinks it proper may order for Cancellation of such written document. There may be documents of contract which are void as they are against Law Public Policy or violable if they are vitiated by fraud coercion or other similar grounds. The parties to the document may also cancel such documents by mutual consent without referring to the court. An agreement for sale, lease, mortgage, licence, partition, may be cancelled by the parties which consent of all parties.

But at times, the matter of cancellation of document may not be so simple as same parties may want to take undue advantage, or very mature of document may not make it simple task. A deed of conveyance which is duly executed and registered cannot be cancelled by mere deed of cancellation. The proper course would be to execute a reconveyance deed and get it duly registered. But if the original deed of conveyance is executed on account of fraud, coercions or incase of any disagreement among the parties, the chances of mutual consent to cancel agreement are very remote. In such cases, the affected party has seek the intervention of the court by filing suit as per the provisions of section 13 of specific relief Act.

If any of the documents are unregistered, it may be cancelled by consent of all the parties by scoring off or by endorsing it about cancellation. But in both cases, all the parties should sign the document for having cancelled.

Cancellation deed attracts the stamp duty as per section 17 ofIndian stamp Act, that is stamp duty is payable only if it is attested by witness. A cancellation deed which is not attested attracts stamp duty as per agreement. If the main deed needs to be registered. Cancellation deed also needs to be registered.

Choice of colour had not been a problem for one's own house before fifties of the last century for majority of the house builders. Lime,Yellow Ochre, Mulatanimitti (Red Earth) had been the natural choice. White was predominant. The colours were used in decoration at the entrance, pooja enclosure and main living room (padasale or hall).They were dictated by culture,tradition and availability of the natural colouring materials in the area. Some colours are considered warm and some others cool. Those colours, which have red or yellow as base, are considered warm. Others, which have blue or green, are, considered cool. Cool colours appear to recede, adding depth to a room. Warm colours seem to advance and make space feel more closed in. Dark colours placed low in the room will make the room defined. Dark colours on the ceiling give a feeling of reduced height to the room while light colored ceiling will create an illusion of added height. Light colours reflect and give a feeling of room being more spacious while the dark colours give the opposite feeling. If the intention is to unify the room use colours of same hue for walls, furniture and furnishings. If the intention is to focus interest, use different colours with contrast. So you can choose the colours so as to create,

It is wise not to go in for expensive colour scheme. In the Indian context, it is desirable to get painting done once in 3 to 4 years. You will recall in olden days it was a custom to do white and Colour wash of a house either before Yugadi or before Deepavali every year. Besides giving a fresh look, it used to remove dust settled on walls, remove spiders web, lizards and small household vermin. According to an observation when the colour of the London Bridge was changed from black to blue, the number of suicide rates came down by 50%. The colour is also recommended to those students pursuing serious studies, which require a degree of concentration. In parts of South India it is believed to be mosquito repellent.

Green, it has been found, has a soothing effect on the mind. It induces relaxation and is used to treat cases of depression, anxiety, nervousness.
Yellow, it appears, has great energizing quality and can be used to treat depression. It improves appetite, memory. The colour when dark, is supposed to be timulating. One interesting study has found" strong links between street vandalism and sodium vapour lights which are yellow when conditions are favourable as in the case of protest demonstrations. 

Yellow is also not recommended for rooms where negotiations take place.

Violet has been found to induce peace and balance. It has been used to treat people suffering from migraine.

Black, in lighter shades it has been found to boost self-confidence. But dark colours may induce boredom, depression and sadness. Dark shade is associated with negativity.

Red,This colour has been found to induce hyphenated/short bursts of excitement. It stimulates heart activity, brain, respiration and blood pressure. The colour supplies short bursts of energetic thinking and has been used in sports activities. The colour is recommended by some for those suffering from paralysis. constipation, bladder infections and some skin disorders. Red is also not recommended where meetings try to achieve consensus as it is found to induce aggressive attitude.

Purple is associated with low key affairs and gray is mild and indecisive. One might observe many areas of agreement between Vastu and scientific findings.

All paints being sold in the Indian Market are not safe. Many of them contain toxic materials. If you are health conscious and an environmental buff you should choose the paints carefully. For colouring rooms reserved for children, pregnant women and convalescing persons it pays to be extra careful. Some paint materials are known to cause allergies and some other, serious illness. However choosing a safe paint is not easy in India because there are no statutory regulations and many paint manufacturers do not fully declare all the ingredients contained in them. Is the product free of all poisons? (For paints used indoors no compromise should be made.)

Are the raw materials used as binders and solvents renewable? Paints and lacquers generally consist of up to 65% of solvents and binders (including water).Examples of raw materials, which fulfill this requirement, are resins from trees and oils from plants.

Is the product solvent free? For ceilings and walls only solvent free (water as solvent) paints should be used. For other applications products with less than 30% should be used.

Paint is made from three basic ingredients: a colouring agent or pigment to provide colour, resin or binder to bond the paint into a protective skin, and solvent which keeps it liquid until you brush it on after which it evaporates away as the paint dries. Additionally other ingredients can be added such as preservatives and fungicides.Generally speaking water based paints are environmentally preferable to enamel or polyurethane paints.

Water based paints have improved dramatically in recent years and are suitable for most applications.There are many different types of natural paints available and a suitable product can be found for most applications. Two examples used for centuries are lime washes and silicate paints. One is familiar with lime washes. Repainting is required more frequently than for conventional paints. Silicate paints are based on potassium silicate and they react with the mineral substrate that is painted.

This causes the paint to become part of the surface, rather than forming a film over the top of it. This type of paint is very durable and has given effecti ve protection for over a hundred years.Natural timber can be finished with oil, as an alternative to polyurethane. This will protect the timber while allowing it to breathe. The oil is absorbed into the wood, sealing the pores and stopping water from penetrating. Oils can also harden the wood and give some protection from UV damage.

One should be careful with paints, which contain metallic oxides. Better they are avoided. Substances that are prohibited (except for impurities of no more than 0.1%) include mercury, arsenic or selenium or their compounds, and pigments of lead, cadmium, chromium or antimony. The paint must not contain any confirmed human carcinogens (cancer causing) or formaldehyde, and must not contain ethylene glycol as an integral part of the paint formulation. Hydrocarbon solvents and aromatics are to be limited at certain levels.


The paint containers must also contain information about inflammability, disposal and cleaning methods. An individual who cares how he spends the money and how he can use it for the family's well being will do well to take note of the influence the colours exert on one's daily life as revealed by the recent advances in research in this particular field and accordingly decide the colour scheme of the different spaces of his house. ALLOTMENT OF SITES BY BDA


Bangalore Development Authority has become hyperactive and has been distributing the sites in large numbers. Naturally the people are eager to know the methodology adopted by BDA in allotting the sites. This write up gives the broad out lines of the procedure followed by BDA.

Bangalore Development Authority (allotment of sites) Rules 1984 govern the allotment of sites. These rules are periodically modified. Whenever authority forms an extension or layout; offers the sites in such extensionllayout to the general public, wide publicity will be gi ven mentioning the location, number, area, and last date for submission of applications. The details are also published is not less than three newspapers of Kannada and English, which are published from Bangalore having wide circulation.

Authority is empowered to set apart, 40% of the sites to economically weaker section at 50% of the value of the sites; out of this the 15% of the sites are reserved to schedule castes, 3% to schedule tribe and 2% to the schedule tribes and remaining sites to economically weaker sections. BDA may also allot sites on lease basis to educational, religious, charitable institutions, which are registered under societies registration act, or Trust for public purposes.But such allotment should not be more than 5% of the total site area in each layout. Further sites reserved for civic amenities, public parks and playgrounds cannot be allotted in such manner.

REGISTRATION
Only the persons who have registered their names on payment of prescribed registration fee are eligible to apply for allotment of sites. The registration fee at present is as follows: -

c)            below 350                                   Rs. 500/-
d)            Below 225                                  Rs. 100/-

If the applicant withdraws the registration the registration fee paid less 10% will be refunded to the applicant. Registration once done is valid for any subsequent attempts.In case the applicant dies after registration, the spouse, of the deceased applicant is entitled to apply for allotment. If the spouse is not alive the dependent children, will be deemed to have registered area have right to apply for allotment. The registered applicant or his legal heirs have to apply for allotment of site in prescribed form (form II).

The applicant should also remit 12.50% of the notified cost of the site along with application as initial deposit. The initial deposit payable in case of Schedule Castes, Schedule Tribes, area backward tribes is 5%.The correctly filled application along with initial deposit should reach the authority before the time fixed for receipt of such application. The BDA notification generally informs the mode of paying the initial deposits, by remitting to certain banks. The completed application forms may also be handed over to the specified branches.

In case the application is pending with BDA for allotment and the authority invites applications for further sites, the applicant should again apply in form II (A), but there is no need to pay initial deposit.

ELIGIBLE PERSONS
Only a person who is major, and a resident of Karnataka for not less than 15 years prior to the date of registration, and who or whose family members does not own a site or house on Bangalore, or not allotted any site or house by BDA or Housing Co-operative Societies is eligible to apply.

The requirement of 15 years residence in Karnataka is subject to relaxation in case of persons who are residents of Karnataka, but being employed in armed forces serving outside Karnataka; have gone out of the state for employment, higher education, but have bonafide intention to settle in Bangalore metropolitan area. BDA may also waive this condition with the prior permission of the government, in case of persons who have achieved outstanding performance in field of art, science or in any other field.

The allotment of sites to different segments of society on percentage
basis is as follow.s: -
a)   Backward tribes - 2%
b)   Scheduled Tribes - 3%
c)   Scheduled Castes - 13%
d)   Members of armed forces Ex-servicemen, and members of the families of deceased service
men. - 10%
e)   State government employees - 10%
f )   Employeesof central government public sector undertakings, statutory bodies owned or
controlled by state or central government - 8%
g)   Physical handicapped - 2%
h)   General public - 50% Persons who have outstanding achievement in this field ego Arts, Science, Sports - 2%

If sufficient number of applicants are not available in category A the balance sites will be transferred to category B, then to category C, and then to category H (general public) likewise in the absence of sufficient number of persons in category E, F, G, I, the balance sites will be transferred to category H (general public).
The word outstanding achieve- ments is defined as achievement at state, national, international level, where an award or a medal is pre- ser.ted by the authorities duly rec- ognized by state or central government.

Recommendations of the Supreme Court Panel on forest land



Nearly 5 lakh residents living on the periphery of the Sanjay Gandhi National Park (SGNP) like Thane, Mulund and Vikhroli on the eastern suburbs and malad, kandivili and Poisar in the western suburbs were affected by a High Court verdict last year notifying their land. Some hugehousing complexes as well as settlements in existence for over six decades weredeclared ‘illegaql’ in the verdict.

Parkash Paddikal of Mulund-based NGO Hillside Residents Welfare Association (HIRWA), said, “Based on the CEC’s current suggestions and the Net Present Value for these lands, we have calculated that residents with OCs may have to pay about Rs 8-10 lakh to regularize their homes. Considering the pressure we have been under for so long, that seems an acceptable suggestion.”
As for residents without valid OCs, the CEC has agreed to consider their cases after their applications with details are duly filed, Paddikal said. HIRWA, alongwith the NGO Pelople’s Power of Nation, has been fighting for the residents’rights for long. That seems an acceptable suggestion.”

Rajendra Manglurkar, joint secretary of the state Revenue and Forest department, said, “The illegal forest issue has been hanging in balance for the past 34 years and we want it to be resolved once for all. If the CEC’s solution is acceptable to thepublic, we are more than happy with it.”

KOLKATA-BASED Eden City Projects has come up with a new scheme for its residential projects, which requires an applicant to pay only 15 percent of the cost on allotment and the remaining amount as monthly installments two years later, on getting the physical possession of the flat.“Book nowand start paying in 2011”, seems to the buzzword in the realty space.

Explaning the scheme, Biswadeep Gupta, General Manager said, “In the scheme called Empower all one has to do is to fill up the prescribed application form with requisite booking amount, which is not very high. Pay 15 percent of the total value on allotment and sign a home loan agreement with the developer’s home loan partner (which could be HDFC, ICICI or someone else) and start apying the rest of the money as equated monthly installments (EMI) only from 2011 onwards, after the developer actually gives physical possession of flats. An increasing number of developersare coming up with similar schemes, which is just another name for discount, withoutactually reducing the price of property.

It means one has enough time to save up for a house. People who pay rent would be spared from the burden of paying monthly installment also, and no interest would be charged for the interim period either. Eden City Projects was one of the first to start the scheme when slowdown set in. Others such as to pay Rs 2.24 lakh as booking amount and start paying EMI from 2011. Similarly, for a three-bedroom flat of 1,236 sq ft, whoseprice is Rs 22.57 lakh, one has to pay a booking amount Rs 3.38Iakh, he said.

Ruchi Realty Holdings, the realty arm of Ruchi Industries, has also come up with a subvention scheme. Shivam Asthana, vice- president of Ruchi Realty, said his company has teamed up with HDFC to offer this subvention scheme. Interestingly, the developers in all such cases are bearing the burden of pre-EMl interests. For all practical purposes, therefore, it is all but a heavy discount offered to customers in a different format.

The Bombay High Court has sent notices to RBI and others to respond to public interest litigation (PIL) that sought the court's directive to banks to put up signboards on mortgaged lands on which construction was being undertaken A division bench of Chief Justice and Justice Dhananjay Chandrachud was hearing PIL filed by one Rajendra Thacker against RBI, Syndicate Bank, Housing Development and Infrastructure (HDIL)and Enigma Constructions, which issued a brochure under the brand name Rustomjee Estate. The brochure, however, did not mention that the land was partly mortgaged to a bank.

The petitioner's lawyer Sumedha Rao said: "We want banks to put up signboards stating that the land has been mortgaged. Also, the banks should publish a list of properties on which they have a mortgage or a charge." The petitioner's contention was that if the land's title was in dispute, the builder cannot 'convey' good and marketable title of the flat to owners unless the litigation over the title ends. In such cases, the buyers may get cheated of their rights in the property for which they have paid full consideration.
